By purchasing our products or services, customers agree to the following Terms & Conditions. Please review them before booking. 1. Seasonal & Natural Products Pumpkins, gourds, mums, corn stalks, hay, and other natural materials vary in size, shape, color, texture, condition, and appearance. Photos shown on our website, advertisements, and social media are representative of the overall style and scale of our work and are not guarantees of exact varieties, colors, quantities, placement, or appearance. We select seasonal products based on availability, quality, design, and the characteristics of each property. Natural imperfections, variations, discoloration, irregular shapes, and changes that occur after installation are normal and are not considered defects. 2. Package Design & Substitutions Each installation is individually styled for the customer's property. Package descriptions represent the approximate scale and overall design level of an installation rather than an exact replication of photographs shown online. Falling Pumpkin Delivery reserves the right to substitute pumpkins, gourds, flowers, plants, hay, corn stalks, or other decorative materials with items of comparable quality or visual impact when seasonal availability requires. 3. Installation The customer authorizes Falling Pumpkin Delivery and its employees, contractors, and representatives to enter the areas of the property reasonably necessary to complete the scheduled delivery, installation, photography, or removal services. Customers are responsible for ensuring that the installation area is reasonably clean, safe, accessible, and free of hazards. Unless specifically included in the purchased package, our services do not include moving furniture, repairing surfaces, landscaping, construction, electrical work, or modification of the property. We may refuse or modify an installation if we reasonably believe a requested placement could create a safety hazard or cause property damage. 4. Outdoor Conditions & Product Lifespan All installations are intended for outdoor seasonal display. Once installed, pumpkins and other natural materials are exposed to weather, temperature changes, sunlight, moisture, insects, wildlife, pets, vandalism, and other conditions outside our control. We do not guarantee how long pumpkins, plants, flowers, hay, corn stalks, or other natural materials will remain fresh or maintain their original appearance. Falling Pumpkin Delivery is not responsible for deterioration, rot, mold, discoloration, animal damage, insect damage, weather damage, theft, vandalism, or other changes occurring after installation. 5. Weather Fall weather in the Pacific Northwest can be unpredictable. Installations may be delayed or rescheduled because of heavy rain, wind, extreme temperatures, unsafe road conditions, wildfire conditions, or other circumstances that make delivery or installation unsafe or impractical. Weather-related rescheduling does not automatically entitle the customer to a refund. If we are unable to perform the purchased service within a reasonable period because of circumstances beyond our control, we will work with the customer on an appropriate resolution consistent with applicable law. 6. Cancellations & Refunds Because Falling Pumpkin Delivery purchases and reserves seasonal inventory, labor, transportation, and installation capacity based on confirmed bookings, all sales are subject to the following cancellation policy: More than 7 days before installation: The customer may request cancellation. Any refund may be reduced by nonrecoverable costs already incurred specifically for the order. Within 7 days of installation: Payments are nonrefundable except where otherwise required by applicable law. After delivery or installation has begun: Payments are nonrefundable except where otherwise required by applicable law. Rescheduling requests are subject to availability and are not guaranteed. Nothing in this policy limits any cancellation, refund, or other consumer right that cannot legally be waived. 7. Customer Satisfaction Because each installation uses natural products and is individually styled, subjective preferences regarding pumpkin shape, color, variety, orientation, or arrangement do not constitute a defect. If you believe we materially failed to provide the package or services purchased, please contact us promptly. We will have a reasonable opportunity to inspect and, when appropriate, correct the issue. 8. Property Conditions & Damage We will use reasonable care while working on your property. The customer is responsible for informing us before installation of fragile, unstable, valuable, concealed, recently painted, recently constructed, or otherwise sensitive surfaces or objects in the installation area. Falling Pumpkin Delivery is not responsible for pre-existing damage, ordinary wear, staining or effects caused by natural materials, or damage resulting from conditions we could not reasonably identify. To the fullest extent permitted by law, Falling Pumpkin Delivery will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. 9. Children, Pets & Safety Pumpkins, hay bales, planters, corn stalks, and other decorative materials may be heavy, unstable if moved, or attractive to children and animals. After installation is completed, the customer assumes responsibility for supervising children and pets around the installation and for maintaining the installation in a safe condition. Customers should not climb, sit, stand, or allow children to play on decorative installations. 10. Customer Changes After Installation Once an installation has been completed, Falling Pumpkin Delivery is not responsible for damage, instability, deterioration, or changes resulting from the customer or another person moving, rearranging, adding to, removing, or otherwise modifying the installation. 11. Removal Services Post-season removal is included only when expressly stated in the purchased package or separately purchased as an add-on. Removal dates may be scheduled within a general service window rather than at a specific time. Removal includes reasonable removal of Falling Pumpkin Delivery's seasonal installation materials. Disposal of unrelated decorations, household items, landscaping debris, or materials added by the customer is not included unless separately agreed upon. 12. Photography Services Photography is included only in packages that specifically state that professional photography is included or when purchased separately. Photography sessions may be rescheduled because of weather, illness, unsafe conditions, or other circumstances reasonably affecting the quality or safety of the session. The photographer retains creative discretion regarding posing, composition, lighting, image selection, editing, and final delivery. The number of final photographs and other deliverables will be those stated in the photography package purchased. RAW or unedited files are not included unless expressly agreed to in writing. Customer use of delivered family photographs is for personal use unless otherwise agreed in writing. 13. Marketing Photography We may photograph completed porch installations for documentation and portfolio purposes. We will not use identifiable photographs of customers or their family members for advertising or promotional purposes without appropriate permission. Any separate model release or photography release presented to a customer will govern the use of identifiable family photographs. 14. Scheduling & Access Installation dates and arrival windows are estimates unless specifically confirmed otherwise. Customers do not need to be home for installation when safe and reasonable access to the agreed installation area has been provided. The customer is responsible for providing accurate address, access, gate, parking, and property information. Additional trips caused by incorrect information, inaccessible property, locked gates, unsafe conditions, or other customer-controlled access problems may result in additional charges. 15. Delivery Area & Mileage Published package pricing applies within Falling Pumpkin Delivery's designated service area. Properties outside the standard service area may be subject to additional delivery or mileage charges. Any applicable additional charge will be disclosed before the additional service is confirmed. 16. Force Majeure Falling Pumpkin Delivery is not responsible for delays or inability to perform caused by circumstances reasonably outside our control, including severe weather, road closures, natural disasters, government actions, supplier shortages, vehicle breakdowns, labor disruptions, or other unexpected events. When reasonably possible, we will attempt to reschedule affected services. 17. Maximum Liability To the fullest extent permitted by applicable law, Falling Pumpkin Delivery's aggregate liability arising from an order will not exceed the amount actually paid by the customer for the specific goods or services giving rise to the claim. This limitation does not apply where such limitation is prohibited by law. 18. Governing Law These Terms & Conditions are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. 19. Acceptance By placing an order, paying an invoice or deposit, or otherwise confirming a booking, the customer acknowledges that they have reviewed and agree to these Terms & Conditions. These Terms are subject to any rights or protections that cannot legally be waived under applicable federal, state, or local law.
